Dispute a CCJ

Hi all

My Daughter has a CCJ from like 4 odd years ago

Apparently there was a parking ticket under a car she wasn’t registered to. She didnt even have her license at the time, never mind a car. 

The ticket wasn’t paid for so it ended up becoming a CCJ

She only found out about it when they moved into their house and the estate agents ran some tests - 3 months ago

Any ideas how to fight this please?

    She needs to have it set a side...however I would double check why it is in her name given the info above.

    If the CCJ is 4 years old, it may not be worth paying out for a set aside, £303 with no guarantee of success, plus if it is 4 years old its only got 2 years to run

    Agree with the others about just letting it slide now.  But the concern would be why she got a ticket if she didn't drive and didn't own a car.  Has she checked her credit history for any other oddities?  Any credit taken out that she's of which she is not aware?

    You/she needs to unpick this and the place to start is by phoning the CNBC with a copy of the judgment in her hand (they won't talk to you) and asking for a copy of the N1 claim form to be emailed to her.

    OK some updates

    As part of the eligibility checks she got the following:

    We have received your referencing form back and it has come back as not acceptable due to an active CCJ on your credit file for £322.

    Record: County Court Judgement
    Case Number: XXXXXXXXX
    Court: Civil National Business Centre
    Address: XXXXXXXXXXXXXX
    Amount: £ 322
    Date: 03/05/2022
    Satisfied/Discharged: No

    My Daughter only passed her driving last year and she still doesn't own a car.

    She then emailed ccbcfees@justice.gov.uk asking for further info but never heard back

    Thoughts?

    What should we do first?

    Who is the claimant. ?

    You were asked how she could possibly get a CCJ if she wasn't a keeper or driver. ?  Not answered 

    The parking company had no possible way of getting her personal details, so doesn't make sense 

    You should be answering the basics if you want answers here

    The facts as they stand don't make sense. Was this an attempt to avoid a penalty incurred by someone else that now has gone badly wrong. Your daughter unfortunately suffering the consequences.
