Euro Parking - Change of driver to £140 final reminder!

  • Hi Coupon-mad, as outlined in the original post.  All three were originally in my name as the registered keeper.  Then changed the name to son who was using the car at that time for all 3.  The parking used to be free in the evenings.  The land owners then made a change, many drivers were caught out by this.  We did go to the owners at first.  They directed us back to Euro Parking.

    Evening all, 

    Received 3 x PCN from Euro Parking Feb 2024.  Son was using car so went online and filled in relevant section to advise of correct driver within 28 days.  Plan was to get name changed and then take the PCN direct to the owners where son had a membership, if that failed, then would pay the £60 for each PCN.  

    A few days ago (almost 5 months later), received all 3 PCN with updated name, however they've been issued as final reminders £140!  

    100% we've not received a previous PCN with updated name.  

    There's no way of contacting them anywhere on the PCN.

    Oddly, PCN still states failure to pay within 28 days will result in the full charge of £100.


    Update:

    Received a letter before claim from Gladstones.  Do we reply to this or wait for the court claim?

    How long was this after the change from being free, if this was within the first four months they are out of order?
    The Joint COP states:

    3.4. Material changes – notices

    Where there is any material change to any pre-existing terms and conditions that would notbe immediately apparent to a driver entering controlled land that is or has been open forpublic parking, the parking operator must place additional (temporary) notices at the siteentrance for a period of not less than 4 months from the date of the change making it clearthat new terms and conditions/charges apply, such that regular visitors who might be familiar with the old terms do not inadvertently incur parking charges.

    NOTE: Examples of material changes can include introduction of parking enforcement
    where none has previously applied, introduction of time-limited free parking, or reductions
    in the time limit within which free parking is available. Given the need to avoid confusion
    and clutter at entrances the test is whether the fact that a change has been made is clearly
    signalled to drivers on entering the land and the nature of the change is clearly displayed
    thereafter – it may also be necessary to install repeater notices depending on the scale of
    the premises.





  • Response has been sent, thanks.  Also, yes it was within 4 months from the new 24/7 charges being introduced.  As far as we can remember, there was no additional notices about new term/charges now applying. Many people used the car park in the evening which used to be free.  This change was in winter and clearly many didn't notice the new signs from Euro Parking.

    When the change first happened, the new parking company issued out "fines" to those who had paid!  Land owner issued this at the time.

    That'll be good evidence of failure to operate professionally, if and when you might get a claim form to defend.

    The landowner is deluded. How do they fall for this rubbish and even let a PPC carry on after issuing PCNs to paying customers? Whose side are they on?!
