Form c1(2022) Section 2 Declaration - Help Needed

need some help with the declaration section 2 on the C1 form.  The rest of the form is good and complete but the court are advising there is something missing from section 2 but obviously can't say.  In summary it is a large estate, we have the original will and was certified by a lawyer at time of writing. My mother has passed away and in line with the will, I as son am executor with the 'if failing' clause in the will, my late sister would have been executor.  Both my mother and I have different addresses from when the Will is written. New addresses are in the other sections and tried to reflect the change of addresses in the declaration box.  I am unable to post images but the rest of the document is ok with the court just the section 2.  See below for the section 2 contents.  Thanks for all the help provided so far which has go me through the document but have hit a brick wall here.. Any suggestions please?

2. That I am

Mr <full name> the son of the said deceased and Executor Nominate, conform to the Will by the deceased Mrs <full name> dated 10th September 2004 which Will is docquetted and signed by me as relative hereto and produced herewith.  In the said Will, the deceased is designed as residing at <full address as per will> and I am designed as residing at <full address as per the will>. In said Will the said deceased's daughter <full name> is appointed executor in my failing but she predeceased the deceased.  The deceased never remarried or entered into a civil partnership.

    When you say ‘certified by a lawyer at time of writing’ do you mean the person signed as a witness?

    I am assuming that you have (correctly) not included your sister in box 10 on page 1.

    Declaration

    While there are a few words short, it looks more like a case of too much information. Here is a suggestion for para 2 of page 2:

    That I am

    the son and executor-nominate of the deceased conform to her will dated the tenth of September 2004 which is exhibited, docquetted and signed by me as relative hereto. In said will I am designed as residing at [will address], a former address and the said deceased is designed as residing at [will address] a former address.


  • Hi Buddy9, thanks for replying as I am really struggling with this..
    Yes the lawyer and my mother signed the will and I have the original version.
    We did not include my sister in box 10 on page 1.
    I had added my sister on 2nd submission based on the fact she was mentioned in the will and the court said something was missing.
    I really hope the addition of ‘a former address’ gets it through. 
    I’ll update to this format and try again.. Thanks again
