Buying Ex out of mortgage

I have managed to secure a mortgage in my own name to be able to buy my ex out of her share of the equity about 9K is coming from the mortgage and the rest from my parents.
We have been split for nearly 9 months now but not yet divorced or any financial agreements, I'm just wondering before I start the process, say I buy her out give her her equity and have the whole house in my name when it comes to splitting the assets could she theoretically say she wants half again?

    Speak to a solicitor. Financial consent order ensures that there's a clean break with an agreed division of assets.

    Yes she could.  Splitting assets before the financial order always carry risks as the court themselves may tell you to give her half of the house even if she didn't ask for it! (Annoyed emoticon). So it is best to wait until the financial order is complete if you can. 


    I am doing the asset split before the financial order but I do know there is a risk.

    The safest option would be sorting the divorce first and getting the split confirmed in a consent order.

    If (while married) I empty our joint savings into my own bank account, I wouldn't be entitled to keep all the money after a divorce because it's in my name.

    Even whether couples agree on a split, courts can disagree if they feel it is unfair.

    I would tread very carefully before deciding to commingle your parents money with matrimonial assets pre-order.
