Confusion at Magistrate court and wrong address

    Just seen your reply re my son’s dyslexia and not taking it the wrong way at all. We have no reason to believe the error in writing his address was down to his dyslexia. In any case there is evidence on text and email that the police got in touch to ask for his address so they could send the SJPN. I have seen for myself the reply my son sent and the address is correct.

    My son then follows on with a text a couple of weeks later to say he has not received anything. The policeman then gives the date it was sent and asks for an email address. The SJPN arrived by email a week or so before the hearing and this is when my son texts back to say the address is incorrect.
    The policeman apologises and says it’s an admin error.
    in other words I believe the error in address originated from the police.
    Hope this explains things as I see it.

  • Update: with the continuing harassment from the bailiffs, I’ve today written to the bailiff company to formally notify them of the section 142 request. I sent a copy with my son’s address redacted for obvious reasons. I hope this will suspend their actions for now. I understand from a paralegal friend that courts are inundated at the moment and it’s taking on average about 60 days to get a response from correspondence sent so hope the bailiffs will be a little understanding.

    I'm afraid this probably won't help concerning the bailiffs.

    As far as they are concerned your son has been convicted of the offence and their job is to enforce the unpaid fine...


  • Thanks @okell, just trying to cover all bases and at least put it on record that we tried that as well. Someone on FTLA suggested we contact bailiffadviceonline dot co dot uk so we have done that as well.

  • Good news!!! We received an email reply today from the bailiffs with the following…

    Please be aware that this matter has been returned to the Client and therefore, our action has ceased.
     
    We trust this will assist you.

    … reason prevailed after all.
    We are now waiting to hear from the magistrates court concerning the section 142 request. 
    Will keep you posted.
