So you’re saying that I should still proceed with the defence?

Yes, until you receive a N279 from DCBL because the claim is still live, the court won't send one.

Definitely defend.

Add a paragraph to tell the court that the PCN has been cancelled but you are forced to defend because DCB Legal have not discontinued the claim, and if the case is left hanging ('stayed') indefinitely, the Defendant hereby objects to the Claimant or their agents processing the Defendant's data, except in August, to confirm claim discontinuance.  The Defendant's postal address must not be presumed to remain unchanged indefinitely and will not be good for service if the claim is ever resurrected after 2024.

I’m also not going to use their car park until they discontinue this claim. I’ve been using this car park at Peterborough since 2021 and have been paying Parkmaven an average of £80 per month since they took over management of this space since Jan 2023. Not sure the recent cost of living crisis affected them or they have a new staff/manager as they started sending PCNs aggressively since Oct 23 despite I was paying regularly. Around 10 PCNs in total. All of them were appealed successfully except this one because there was no PCN received in the first place. Though appeals were successful, administration of these bogus claims have become a full time job. The response to the most recent appeal received last week was this:

Thank you for your appeal against the above Parking Charge Notice. We have carefully considered your appeal and on this occasion the appeal has been accepted and the charge has been cancelled.

Unfortunately, it appears on this occasion there was a technical error which meant your vehicle registration was not sent through from the booking platform (YourParkingSpace) to our PCN processing system. We can confirm this has now been resolved.

Moving forward, please ensure that your booking covers the entire session of your parking to avoid getting a parking charge.

It sounds as if it’s not their mistake but an error with the ‘booking platform’ though I paid in time. There was no apology and they make it sound as if they are doing me a favour!!! I remember reading in another thread here that both ParkMaven and YourParkingSpace are owned by the same person(s)!

Dear Parkmaven,

You went as far as suing me after obtaining my DVLA data without reasonable cause.

On what planet are you living on if you think for one minute, that 'moving forward' I will EVER use your car parks again?

I had been using this car park at Peterborough since 2021 and was paying Parkmaven an average of £80 per month since you took over mismanaging it in 2023. You and your duff system are useless.

You have completely and utterly wasted hours/days of my time and abused my DVLA data for the best part of a year, sending PCNs since Oct 23 despite me paying regularly. Around 10 PCNs in total.

All of them were appealed successfully but guess what? This isn't my job. My time is worth a lot more than this and you won't see me or my car again. Other car parks are available and you've lost my business.

I hope you get found out by the Scrutiny Board and are among the first of your rogue industry to get banned by the DVLA when the new statutory Code finally replaces the joke one the IPC and BPA have conspired to invent.

This is the response received today:

“We apologise again for the inconvenience this has caused you. We are currently undergoing a transition from an older system which affected a few of our processes.
 
We are doing our best to mitigate the issues but there could be some that fall through the cracks, we sincerely apologise for this.
 
We have already reported this issue to our IT department and hopefully, this will not be repeated.

DCBL responded separately to my wife’s request to send N279 they are not going to issue this now as ‘the file is closed’.

I sent ParkMaven an email today informing that any loss the defendant or I may incur due to their bogus claim will force us to open a counterclaim against them. And I was not joking..
