    Hello. Yes it's definitely a section 75 claim. This was mentioned by the CC provider.
    I did have a little bit of free legal help putting the main part of the claim together, to include the correct wording regarding breach of contract / misrepresentation etc to tie in with the evidence sent in.

    In my original question, I asked if it would be too late once paid out, as the case may be seen as closed.
    I wanted to establish procedure...

    "after they've paid out on the car and I've accepted the funds, will I have lost my right to complain later and try and recoup at least some of the consequential losses?"

    I have answered this for you already - accept without prejudice then tell them the case is not closed.
