Correct. His banks were not informed of his death.
A friend suggested that the government could claim his shares but I don't think that's true?
That is not true, but this should not be allowed to go on.  Does someone have power of attorney for her?

Absolutely agree with K_p, this situation must not be allowed to continue, likely to be a nest of vipers for her executors in due course.

Not, being rude, but her behaviour ( in these respects) strongly point to the installation of financial power of attorney asap, although her continued failure to notify various financial institutions of her husband's demise would in my mind,  put a bit of a question  mark over the issue of her competency.

Wouldn't wish to be an executor. Sorting this estate out. The reluctance on your Aunt's part is understandable.

    Hi
I have tried to but she refuses any "interference".
She and I are currently not speaking because of this.
I am also worried about tax implications. She pays tax on her own income. But the dividends on the shares still in my uncles name are not taxed. I suspect as they are really part of her income that they ought to be.
Some of the household utilities come out my uncles bank accounts (I think).
    It's a mess already.
Unfortunately she's as sharp as a whip. She just refuses to fill in any forms. Or listen to any advice.

Hopefully the dividends are not large enough to have pushed her into higher tax ( they are her income ).

If this situation persists until her death, the executors will be expected to calculate all back income tax due and settle from the estate.  HMRC also have powers to penalise the estate up to 100% of the income tax avoided together with interest thereon. Without doubt a nest of vipers awaiting her executors, unless HMRC get wind of the situation prior to.

Her being 'sharp as a whip' makes the position worse, suggest she knows exactly what she is doing. Also begs the question what else she is deliberately hiding of which you maybe wholly unaware.

You could if you wish force action on her part.  Cruel to be kind so to speak. Sharp as as a whip. Might simply be the old best form of defence is attack line. Trouble is only takes one card to get blown over and the whole house will come tumbling down.
