Faulty Fridge Freezer

I have a faulty built in fridge freezer that has developed a fault and the Manufacturer has agreed a replacement as it is less than 1 year old. They put me back to the supplier who says he will deliver a replacement and take away the faulty appliance. The freezer has a damaged thermostat which cant be repaired due to broken wiring in the casing.
He says he will not fit the item into its housing (as he does not employ a fitter) and wants me to remove the old one ready for him to take away. I have already paid to have the original fitted in the first place, can I claim my costs off the supplier for having the faulty one removed from its housing and re-fitted? I am 75 and cannot remove it myself.
Also we are running down the contents of the F/F in case we don't get a fitter to come at the time of collection. If there is any food loss can that be claimed for?

As you are dealing with the manufacturer you are talking about a warranty claim and that comes down to the terms of the warranty of what it does and doesn't cover. Removal/Fitting may or may not be covered depending on the quality; food is highly unlikely to be covered.
If you had dealt with the seller under your statutory rights instead then they would have been liable for the fitting costs and food that was lost directly because of the failure (assuming the freezer defrosted). For food lost because of the transfer of devices I think thats harder to justify that it couldn't be mitigated with some cold boxes and ice blocks.0 -

But its the manufacturer thats made the decision and so its a warranty claim... you'd need to make the claim against the seller, who may choose to delegate to the manufacturer for a report, but it is ultimately the seller that needs to make the decision for a statutory right decisionAlabet70 said:Thanks for that, I was dealing with the manufacturer but I have been passed back to the supplier.0 -
The retailer is who you bought it from and who your contract is with, yes they can replace but also could refund you and reduce the refund if the f/freezer is over 6 months old, its there choice not yours
If there pushed to hard they could go down this road
Local kitchen fitters would remove and install for £50-60

If you paid by credit card you could claim for the removal & new install fee.
Not sure if it would work, but it wouldn't cost you anything but time.
