TERMS AND CONDITIONS for “Despicable Me 4 x HITS – On-Air Competition” (the “Competition”).

These terms and conditions (the “Specific Terms”) for the Competition should be read alongside our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail. 

1.ENTRY ROUTES AND COSTS

ON-AIR COMPETITION: 

Entries are restricted to one entry per person. 

Entry to the Competition is available via the following routes:

2.COMPETITION MECHANIC AND HOW TO WIN

ON-AIR COMPETITION: 

There will be one winner across the day of this competition which takes place on Wednesday 3rd July 

To be eligible to win, entrants must text in when prompted to be in with the chance of winning the prize (outlined in Section 5: The Prize). To enter the competition, all you need to do is engage with Hits Radio when prompted by texting ‘DESPICABLE’ throughout the day. 

Mechanic: 

• Sam Thompson has gone into hiding! And Joe Swash will be finding out where Sam is hidden. 

• Throughout the day, there will be clues as to where Sam may be hiding. And you have the power to help Joe Swash with some clues throughout his day of searching. 

Listeners who text in may be called to join the Hits Radio presenters live on-air from 7am until 6pm where they will talk about where they think Sam is hiding! 

The winner will be selected randomly from all those that text in including the prompt ‘DESPICABLE’ and the randomly selected entrant will join the presenters live on air in the following show: 

• The Hits Radio Drivetime show with Gemma and Mike (4pm-7pm) – Selected contestant will have their winning moment 

The chosen contestant must ensure that they answer the phone to be in with the chance of winning. If the winner doesn’t pick up, another contestant will randomly be called. 

1. ENTRY PERIOD 

ON-AIR COMPETITION:

3) Entries received before the Start Time or after the End Time will be invalid. 

4) Winner Announcement: The winner’s first name and hometown are available on request by emailing win@bauermedia.co.uk 

5) However if the winner cannot be contacted within 28 days from the date of the initial attempt to contact them, then we will re-draw until we draw a winner that we are satisfied (in our sole discretion) fulfils all of the eligibility criteria and is in compliance with these Terms. 

1. ENTRY RESTRICTIONS ON-AIR COMPETITION: 

• Open to UK residents aged 18 years or over on date of entry. 

• Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter. 

• We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Terms.

1. THE PRIZE 

ON-AIR COMPETITION: 

One winner will receive the following prize (the “Prize”): 

Prize package for 2 adults and 2 children under 16 years old includes:

• Rental Car: For 4 days, to be picked up from Paris airport, incl. GPS hire

• Private Karaoke Session at Chateau: (1 hour)

• Arcade Experience: Includes €100 EUR spending money for game tokens 

• Dinner at Chateau Restaurant: Provided to the value of €300 EUR, incl. gratuity

• Travel Insurance 

The Prize is provided by Element (the “Prize Provider”). We (Bauer Media) are not responsible for any aspect of the Prize, including unsatisfactory quality or late delivery or a prize winner being unable to take up any aspect, or the entirety of the prize due to their own circumstances or restrictions.

TERMS & CONDITIONS: 

• Prize is for 2 adults and 2 children under 16 years old; 

• The Recipients must travel at the same time with the same itinerary; 

• At least one traveller must be aged 21 or over; Anyone under 18 will require parent or guardian permission prior to travel; 

• Economy flights from major international airports in London only (inclusive of all applicable airport taxes, fees, and duties) to Paris, France; Flights may be indirect and not all routings will be available; Flight itinerary will be selected by prize provider at their sole discretion; 

• Travel arrangements, including costs relating to public transport, fuel or parking, to and from the winner or companion/s’ home and London departure airport do not form part of the prize and are the responsibility of the winner and their travelling companion/s; 

• A valid credit or debit card will be required for security deposit purposes when checking into accommodation; 

• Accommodation is based on 2 adults and 2 children under 16 years old sharing 1 quadruple occupancy room for 3 nights in a chateau hotel in Yvelines, France; 

• Accommodation will be selected by the prize provider at their sole discretion; 

• Accommodation for the Recipients does not include any meals, incidentals, gratuities, or telephone calls. Any other personal expenses incurred during the trip will be the responsibility of the Recipients; 

• The prize excludes meals and drinks, excursions, attractions, treatments, visas, personal expenses and anything not expressly stated in the prize package; 

• All elements of the prize are subject to availability; If unavailable, experiences and items of a similar nature and value may be offered at prize provider’s discretion; 

• Winners must contact prize provider with three preferred travel dates in three separate months no later than six weeks prior to departure; 

• Travel insurance is subject to restrictions and the terms and conditions of the insurance provider. It is the responsibility of the winner and/or their companions to meet any additional costs relating to obtaining insurance cover for any pre-existing medical condition and for any additional costs as may be specified where the winner and/or their companions are aged 70 or over; 

• All elements of the prize must be taken at the same time; 

• Once booked, the prize cannot be amended or cancelled; 

• Prize is non-refundable and non-transferable; No cash alternative is available; 

• All travellers will require a passport valid for at least 6 months on date of travel; any necessary visas or additional insurance are the responsibility of the winner and guests; 

• The prize cannot be taken from 21st December – 4th January (Christmas and New Year), over UK public holidays, or over Easter Sunday; 

• Prize is valid for 12 months from the date of notification of winning, and all travel must be completed within that time; 

• For the rental car, the car type is subject to availability, the named driver must be aged 21 or over, with a full clean driving license that has been held for over one year, any drivers aged 25 or under, or with less than three years’ driving experience, may need to pay a supplementary cost for car rental; if driving license is not fully printed in English an International Driving Permit/ international driver’s license or other paperwork may be required; a credit card (not a debit card) in the name of the driver with available funds (value advised upon booking) will be required by the car rental company in order for the driver to collect the car; 

• For the hot air balloon flight, the minimum height is 3ft9”, the minimum age is 7 years old, it is not suitable for those who are pregnant, have neck, back or heart conditions or any other serious health concerns; 

• For the high ropes park, age requirements will vary by circuit, all children must be accompanied by an adult; it is not suitable for those who are pregnant, have neck, back or heart conditions or any other serious health concerns; The maximum weight is 299 lbs; 

• For the arcade, winner will be provided with €100 EUR spending money; 

• Dinner at the specified restaurant is provided to the value of €300 EUR, including gratuity; 

• £500 spending money is provided to the winner only and will be sent via bank transfer to the winner’s confirmed account; 

• The Prize Provider is Element London Ltd. Any personal data submitted by the winner to the Prize Provider will be treated in accordance with Prize Provider’s privacy policy, which is accessible at https://element-london.com/element-london-privacy-policy-travel-english/

1. DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize. Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. 1. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had. 

1. MISCELLANEOUS. 

• Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms. 

• Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into. 

• We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call. 

• You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route. 

• We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition. 

• Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant. 

• As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize. 

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
