I assume we just ignore "They are just still trying to extort money". However I've now received the following email today along with a attachment of their N180.Good morning
Having reviewed the content of your defence, we write to inform you that our client intends to proceed with the claim. In due course, the Court will direct both parties to each file a directions questionnaire. In preparation for that, please find attached a copy of the Claimant's, which we confirm has been filed with the Court.
Without Prejudice to the above, in order to assist the Court in achieving its overriding objective, our client may be prepared to settle this case - in the event you wish to discuss settlement, please call us on 0203 434 0433 within 7 days and make immediate reference to this correspondence.
If you have provided an email address within your Defence, we intend to use it for service of documents (usually in PDF format) hereon in pursuant to PD 6A (4.1)(2)(c). Please advise whether there are any limitations to this (for example, the format in which documents are to be sent and the maximum size of attachments that may be received). Unless you advise otherwise, we will assume not.
So my question is should we ring up and offer the parking fee of £1.60 again like the original appeal that they declined, or is it just a case of ignoring this as well. Just another attempt to extract money with the continued threat of going to court linked in to it as well?
Oh one final question, do you need to see the N180 that they have issued.
Many thanks0 -
No , Yes , and No
Just follow the advice in the 12 steps in the defence template thread2 -
Never, ever ring an unregulated private parking company or any of their agents, ever.
We do not need to see the claimant's N180, and as I just wrote on another thread, you do not want to touch it with a 3.2m bargepole.
Either wait for the one from the CNBC, or download your own, fill it in and email it to the CNBC and the claimant's solicitor as per the advice in the NEWBIES guide to court and the twelve step guide in the Template Defence thread.I married my cousin. I had to...I don't have a sister.

See you at Witness Statement stage in 2025. Everything in between is standard stuff and covered in the Template Defence first 12 steps and/or in the N180 DQ section of the NEWBIES thread 2nd post.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi I've received a court date and also the witness statement from DCB legal now. I believe I now need to complete my witness statement and send to the court and DCB by the 17/3/2025. I was just wondering how brief this can be based on I was unable to purchase a parking ticket due to the machine not accepting any coins. The evidence they have provided shows I was only in the car park for 18 mins and the payments received around the time i was in the car park only shows payments made by credit cards. So to me this doesn't confirm the machine was working or not regarding coin payments. I the believe parking the car and then trying to pay and then returning to the vehicle for further coins and then attempting to pay again could have easily taken the 18 mins. Is this the only thing I need to include in my witness statement or should I include other stuff from the defense paper? Also I note the court papers mentions that this claim will be block-list of similar claims to be heard. Is this normal practice and does this now mean DCB will attend court?0

DCB will never attend. A legal rep might, if the hearing proceeds. DCB still might discontinue.

You don't include "stuff" from your defence but you do write a witness statement (WS) that is a narrative (story) of what happened on the day and subsequently (if it is relative) and that WS should back up and support what you wrote in the defence.popeye46 said:Is this the only thing I need to include in my witness statement or should I include other stuff from thedefense defence paper?
