Euro Car Parks NTK - Wigan - POPLA Appeal Advice
Good afternoon All,
Can I ask for some assistance/advice please.
My wife recently received a NTK from Euro Car Parks detailing a PCN of £100 reduced to £60 if paid within 14 days. The usual bumf!. We decided to appeal, this is where the dreadful mistake was made!. I was speaking to the person in work who deals with quite a lot of these notices and was assured that it was an easy win and to let them appeal it for me, in my naivety I accepted thinking it would be concluded quickly.
The rejection letter was then received, and I was left trying to figure out my next move. After searching the internet, I came across this site and have been reading it for a few days now.
The person who sent the appeal can’t remember if they named the driver and haven’t got the correspondence as it was completed online. The Euro Car Parks rejection letter doesn’t mention the driver though?
My first question is, does the NTK usually only have one page? as some examples I have seen on here have a second page that go into more detail of the alleged PCN Contravention.
Secondly, I have gone through the Newbie thread and ‘borrowed’ some of the fine examples written on here, and I am hoping to have the POPLA appeal drafted this week. Would you mind looking once completed (it shouldn’t take to long as most was written on here).
POPLA appeal requires submitting before 15/07/2024.
A few notes on the PCN:
Time in car park 1 Hour 10 minute
Entry time 16/05/2024 – 14:27:21
Exit time 16/05/2024 15:37:31
Contravention – The P&D/Permit purchased did not cover the date and time of parking
A P&D ticket was also purchased (I still have it) time: 16/05/2024 @ 14:32 for 60 minutes – This is mentioned in the Contravention, but the times given are only the entrance/exit times.

Forget POFA then. Do not clutter up your POPLA Appeal.
Appeal as driver to POPLA (assuming you were the driver). Your main point is lack of fair consideration and grace period.
They are trying to charge you for an alleged but unproven TEN SECONDS over the mandatory minimum ten minute grace period. Laughable:Time in car park 1 Hour 10 minuteEntry time 16/05/2024 – 14:27:21

Just explain why it took some 4 minutes to pay (finding a parking space, downloading an app or finding coins or queueing at the machine?). Having kids with you or some other reason that took a few mins on arrival?
Then point out that the exit photo shows the car already outside of the car park area and on the threshold of the road giving way (am I right?). Thus, the supposed TEN SECONDS over the minimum (not maximum) mandatory grace period is merely due to the length of the exit road, the operator's camera position and their disingenuous choice to use the far exit image of the car at the junction white lines, waiting a few seconds and giving way to vehicles on the roundabout or main road.
Ludicrous scammery.

I have also compiled a few other responses using the appeals you and others have written on here. I.e Insufficient signage, No landowner authority, ANPR accuracy and have checked wigan council database and cannot find any evidence of planning permission for the ANPR column mounted camera or signage consent. Should i keep all this in the appeal or would you just go with the grace period argument?
You have had this car park on the forum before, Rodney St. Carpark, Wigan.

Go with everything. Popla only need to accept one reason to allow the appeal. But the more you have the better. So if one fails, you will have the others as backup.TheYoungster said:Thanks for the advice Coupon-mad
