    Also found an upper tribunal decision which although the issues are slightly different, the discussion in the decision itself and reasons given are supportive to an award of care component if you prove settled status here for you, your son and son's father and proof of paying contributions will only help.

    Thank you, Danien, for your advice. Really appreciate it. Has been extremely stressful to face this all as it has triggered my grief. Trying to not take it too personal and just focus on what I could do to support my son as much as possible.

    You're very welcome. I'm totally understand this is a such a stressful time for you. It's not personal, it's a very complicated area of benefit law and many decision makers struggle with it. As I said, I'm rusty, so please be sure you go ahead with your appointment for further advice - but be aware that it's such a specialist area, not even all benefit advisers have a lot of knowledge.

    What you need to point out to your adviser is the difference in eligibility for survivors pension and care component of DLA, and that means your son should be eligible for both. Hope the adviser agrees with my read on it and can help you sort it out quickly.
