State pension overpayment?

This is a follow on question to a one I asked regarding funeral expense payment.

My mother passed away on 10th May, she was paid state pension and pension credit totalling £218.15 on 13th, 20th & 24th May total = £654.45

She was also paid £114.80 DLA 21st May

Will all of these payments be due back or was she still entitled to them?

I'm in the process of trying to work out whats what regarding money since she passed.

Thanks in advance.

DLA?  If that's like Attendance Allowance there may be a coupe of weeks grace period after the death before it finishes.

And if she was getting SP & Pension credit I doubt she had much in the way of savings.  Was there enough in her estate to pay her funeral?  If not then it's possible that this won't be payable as they are unsecured creditors.   Presumably you used the "tell us once" service as soon as you were able after her death.

And as far as I'm aware these are your mother's debts so if her estate can't pay anything back then you are not responsible for them.

Sorry for your loss - there's always so many things to sort out.

The pension payments on the 20th & 24th May are more likely overpayment, with the pension payment on the 13th May and the DLA payment on the 21st May some of it will most likely overpayments the rest correct payment.
The DWP does at times get banks to reverse overpayments under the guise of common law, bypassing the usual rules, only the DWP gets away of doing this.
If the DWP haven't reclaimed any payment via the bank, they will need to claim any overpayments for the estate of the deceased. If after funereal expenses there is nothing left, then the DWP doesn't get the money back.
It might not stop the DWP trying to get the money, even from family, but it should clearly be pointed out that there wasn't any money left in the estate to pay unsecured creditors.

The same rules apply for any the bills your mother had in her name.
So if there is a utility bill for example that only gets paid after the funeral costs, it no money left, then bill doesn't get paid.

  • They will certainly reclaim any overpaid state pension, by letter , although it might take a few weeks, it’s not reclaimed from a bank account, as that is frozen on death.

The banks make exception for the DWP (there is a thread about it on here somewhere, I will try and dig it out). Personally I don't think they should take money from a frozen account.
