EBay was sold brand new phone was infact a refurb

I was able to check with F as a serial number. The seller for abusive and wanted me to change return reason (not possible according to eBay) and I leff bad feedback they asked me to remove and accused me of blackmail. Anyway it’s the usual eBay policy wait 5 days they send a free post. If I do it myself and pay it gets lost no refund. I asked for compensation but they don’t offer this unlike Amazon. So yes I am put off using eBay all very getting money back but it may take 1-2 weeks to fully fix and nothing for that abuse i got from seller.

    I'm sorry but I don't quite follow.

    If you open a case of SNAD on ebay then seller needs to send you a label via ebay otherwise the case is automatically decided in your favour. I'm not sure what you mean with the comment 'Anyway it’s the usual eBay policy wait 5 days they send a free post' . If th elabel came through the case then it is free to you, but an ebay label will be fully tracked- although I always recommend still getting proof of posting.

    Then you say '
     If I do it myself and pay it gets lost no refund', no you don't pay to send it back, seller does - and if you don't get a label, then you escalate the case to ebay.

    There wouldn't be compensation whether you bought this on ebay or Amazon - all you are entitled to is a refund for your initial outlay- there is nothing else to claim on top.

    As for the abuse- keep reporting that to ebay as there's no need to take that.

    For future reference, always best to leave feedback after the case has been settled, not before. Get your money back and then deal with feedback, there's no rush. Also ensure feedback meets the ebay guidelines, don't mention cases, or make un necessary allegations against seller as a good seller can easily get that removed.

    Tenth Anniversary 100 Posts Name Dropper Combo Breaker
    I have been told ebay can’t step in until Thursday? Seems a while. The seller has point blank refused to issue a free returns label. Ebay will rule in my favour but i have to sit all week waiting to send this back?

    That's right, the seller has an opportunity to make things right - if they don't and no label is forthcoming then you will get your refund once this is escalated. Once you get your refund all you will need to do is then email the seller , tell them you still have the phone and let them know they will need to make arrangements for it to be returned at their own cost and at your convenience. Then just hang onto the phone until that point.

    Sorry I never updated this topic. So I kept 
    the phone and sold this phone at a loss as eBay’s policy was to wait a week to send back. So I will never know if it was new or a refurb I got an android from Argos for £50 which works well.

    You misunderstand the ebay policy and also my post above. The seller has 5 days in which to issue a label for return, some issue one straight away. That label would have bene fully tracked and at sellers cost, once it was showing as returned the seller would have had 2 days to issue a refund.

    If seller hadn't provided a label then after the time frame expired you would have got an automatic refund anyway, so I'm not sure what you thought you gained by not bothering and selling on at a loss instead.

    However it's all done now and I trust the new phone is working well.
