My husband sadly passed away recently. Our house was purchased in my sole name, I paid the deposit and have been paying the mortgage from my sole account.
I am aware that as my spouse he may have had rights to the property (say if we had divorced). But now that he has died would the estate value include say 50% of the house value?

Sorry to hear your sad news @Oxon
Unless your deeds say otherwise (depending on what you agreed and what, if anything, was drawn up by the solicitor when you purchased the house) then you do not need to include any share of the house value as part of your late husband's estate.1

No it does not, although even if it did it would be covered by spousal exemption.Although though he was not a home owner his residential nil rate band can still be transferred to your estate if needed.2

In other words, part of his allowance against Inheritance Tax can be transferred to you, thus reducing the amount of tax that will eventually have to be paid on your estate when the time comes.Keep_pedalling said:No it does not, although even if it did it would be covered by spousal exemption.Although though he was not a home owner his residential nil rate band can still be transferred to your estate if needed.1
