I recently asked for a mandatory reconsideration because UC failed to deal with a claim for back payment in respect of bedroom tax.
Instead of considering back payments from 2017 they only backdated from January of this year.
I therefore asked them to consider backdated from when the bedroom tax should not have been paid from, June 2017.
They have now rejected this.
They claim that I had twelve months in order to appeal, and because I did nor appeal within twelve months I cannot claim.that money back.
The fact is that I did ask for a reconsideration within.12 months which.the decision maker has completely ignored to take into consideration is.so wrong and annoying.
Surely all evidence should be considered, not just what the decision maker sees fit to consider.
She has and in my.own opinion turned a blind eye to the evidence that would show I followed the correct procedure.
Instead of this she has not only ignored it, she has used it as a reason for my claim being rejected.
The decision maker has also.stated that I cannot appeal the decision.
I was previously told by UC only yesterday that if the decision went against me I had the right to appeal, so I am.slightly confused.
Any advise on the evidence not being considered as should have been the case and any right to an appeal would be really appreciated at this moment in time.
