Help Needed - Samsung TV Backlight Failed, Out of Warranty

    Ignoring the fact they are wrong on warranty supersedes consumer rights. You are not entitled to a free repair on a 2 1/2 year old TV.

    I would strongly argue that a 2 1/2 year old expensive TV sould be more durable and thefore fails under Section 9 (3e) of the Act. Because of that i can ask for repair, replacement or refund (their choice). How long would you expect an expensive Tv to last for without a fault?

    Specificaly states : 

    If the consumer requires the trader to repair or replace the goods, the trader must—

    (a)do so within a reasonable time and without significant inconvenience to the consumer, and

    (b)bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage).

    What evidence do you have to back up that assertion?

    If you bought a brand of TV that was specifically advertised as, say, having a life expectancy of ten years then maybe. However as far as I know that is not common and the generally accepted lifespan for these sort of calculations is five or six years.

    So you may well have a claim for either a repair or if not possible a partial refund of around half of the purchase price, providing you have evidence of an inherent fault. Beyond that you will struggle unless the retailer is inclined to make a gesture of goodwill.
