CREATION EXPECT PAYMENT FOR STOLEN ITEM

Hello sorry if in wrong place.
Placed an order for 3 items with currys. The delivery company have obviously stolen the 2 expensive matching items they didn't deliver.
I am disgusted that creation want the payment , its a chunk of money direct debit 1st one due in a few days! Curry's have been too slow to "investigate" If I don't pay the dd for stuff I didn't get, what happens to my credit report? I am really stressed about it.
If I pay it like currys have said then it means I am happy to pay for it! No chance!
What should I do ? Thank you.

I know its probably stolen as one of the nice older drivers for the company told me a lot of parcels have gone "missing" and drivers start and leave. I also have either had ones smelling of the funny cigarettes and /or bashed up torn boxes. Its a large delivery company that a lot of companies unfortunately use.0

Would be pretty stupid thing to do if Currys know that they had them for delivery..
Sadly creation are only a finance provider. So as far as it goes they want their money. Although you might have a S75 claim depending on the value of the items.
Have you spoken to creation about the issue?

creation said currys need to contact them to cancel. Currys saying investigation going to be another 4 days (dd due in this time) they have already had ages. Currys say just pay it as its shown delivered... no! the vacuum cleaner was , the other item is over £500 worth of camera and the sd card to go with it.0

So if you have had one item, then you owe payment for that. So if Currys agree items not delivered. Then they will advise creation. Bonus you get to pay vacuum cleaner off quicker. Or currys send new items out to you so you are back in the position you should have been.Life in the slow lane2

The issue is if we don't pay we will have credit rating affected and if we do pay we need to be mercy of currys doing the right thing. Will never order an expensive item online again now.0

Let's take a fairly similar situation.... you go into a shop and buy your loved one a £400 present on your credit card. You post the present to your beloved and it never arrives. You asked for credit, Creation loaned you the money and gave it to Currys at your request. You owe them money. Now in the above scenario you'd be claiming from the courier, in this case you claim from Curry's that the item was never delivered. Assuming they accept this then they repay the money to Creation and Creation refund to you any monies you've already paid.
The slight difference here is that it's a single transaction with 1 party and so S75 MAY apply depending on if it was regulated finance you took or an unregulated loan over 3 payments. If it is regulated finance then you could hold the finance company liable for Curry's failure to deliver but it's almost certainly quicker and easier to claim from Curry's.0 -
Currys do have to do their "investigation"; I twice had them deliver an old stock inferior item instead of the one ordered and so had to return it.I collected the second attempt in-store and opened there in front of them.It took them several weeks to do their "investigation" and process the refund.0
