Smartparking fine

Hi,

just after a bit of advice really on a fine I’ve been issued via smartparking.

I met a work colleague on a pub car park one day to drop some kit off for him for a job, I parked on the carpark waiting till he arrived, gave him the kit and then left. I was on the carpark for 20 minutes.

I received a PCN a few weeks back telling me I had to pay £100. I appealed this and just explained what had happened. I honestly can’t recall seeing any signs but I probably wasn’t paying attention.

They have today replied telling me that then appeal has been rejected and I have to pay the fine of £100 and if I don’t, it will be passed to a debt recovery agent.

Do I have to pay this? Obviously I’m in the wrong I know that but £100 just for stopping on a pub carpark for 20 minutes to give a colleague some kit seems insane. If I’ve got to pay it then I will as I don’t want it going against me.

    Read the NTK again and tell us where it mentions a "fine"?
    You have an invoice from a private parking company who are ecstatic that you broke their terms and conditions as they can now hound you for money which is their only interest!
    Nothing will go against you if you don't pay them, and the only way they can legally get money for this is if they take you to the small claims court and win.
    The purpose of this forum is to guide you through the process, unfortunately you have already appealed in a way that was never going to help, but scammers like this ignore anything you say anyway.
    Start by reading the newbies thread on here it's all explained, but in future please don't expect that any private land is yours for free parking, it no longer works like that.
    On the other foot, if the car park had defective or non existent signage which you could not see, for example how was the contract to pay anything formed?

    I really wish you'd come here before appealing it. You had a slam dunk win (see NEWBIES thread for what you should have done).

    You could have won it with a single email, if you hadn't appealed telling them the 'story' and who was driving. That is not how to appeal a private parking charge.

    Do I have to pay this?
    Obviously not and it's not a fine.
