Wages not paid

I recently left my job had final payslip sent to me with correct hours worked, boss is withholding wages saying that I am in breach of contract for notice, am I right in saying that she cannot withhold work carried out but can withhold holding owed extra

    Did you not have anything in writing?  A job offer letter?

    Without anything in writing about notice periods, only statutory notice would be required to be given.  That would be one week, assuming you had been employed for one month.

    Did you actually give notice or did you walk away?
  • Nothing, not even a p60 in April, nest payments not paid, worked 7 days after notice given even trained up replacement

    Ask for the evidence of the contract you have breached and speak to ACAS.

    I'm no expert, but I'd guess a Letter-Before-Action stating that you dispute breach of contract, giving a reasonable time to pay. Also if "She" wants to pursue breach of contract then she needs to send you a copy of the contract with your signature on.
    You'll need to know what action after that ... small claims?

    It might be possible to get the P60 information from your personal tax account (Gov.uk website) or contacting HMRC.

  • Definitely speak to ACAS.   If your pension contributions have not been paid to Nest, contact the Pensions Regulator.

    For the future -
    the size of your employing company is not relevant to whether you can belong to a union.
    It may be that it is even more employment in a small company environment.
