Delivery drive lied about me returing an itea

Basically I orderd an i phone from Sky and it should of came next day but it didnt, so rang them up and they told me this model is 1-2 weeks wait, so they canceled the order and i got a differnt model which would come next day, they told me if the other one they had cancelled comes to refuse delivery, Next day surprise they both came in identical brown boxes which the driver took a pic of me holding them, I said I need to return one and explained so I opened one of them and it was the one that got canceled gave him back and said I dont want this one and told him that I got told they need to return it, However today Sky told me that I accepted both I phones and never gave the driver one back which is a blatent lie on the delivery drivers said, Is there any way of proofing he has it, Would they be able to track the I phone it self once its turned on, Or is it my word against hes, I said at the time Why do you need to take a pic of me holding both when im returning one, he said cause you are going to open on so I need to show proof that I gave them to you unopened,

Times like this a ring door bell would of came in handy !

    You accepted the two items.

    You did not follow the correct returns procedure.

    Proving where the "returned" package actually went is going to be very difficult.

    It sounds like Youbdidn’t return it through the return process, with a return slip and the return address. 

    The package will have your name and address on it , not the Sky return address, and is possibly marked as ‘refused delivery’. 

    I don’t know what Royal Mail do with refused items but if they go into the undelivered items system these get sent to Ireland to be investigated for  a sender address.

    I should of said these are in my moms names as its via sky which is in her name.


    When my mom orderd the Iphones it cleary states The person who orderd it must show ID to the driver and also SIGN for it, it states it can not be deliverd to anyone else, but it was it was delivered to me which is the son of the person who name it was in, I have a differnt last name and did not sign for nothing only took a pic, so by there own rules they failed to complete the sercuity check as the person that needed to sign for it and show ID did not they was at work which shows imo that they can not be trusted when they do not follow there own rules

    They also did not follow there own correct procedure

    You'll need to be in to sign for your phone, tablet or laptop and you'll need to show your photo I.D. 

    Accepted photo I.D

    • UK Passport
    • Foreign Passport
    • Foreign I.D card
    • UK Driving Licence
    • Police Warrant Card/Military I.D Card
    • UK Registered Disabled Card

    It must match the name and delivery address on the order and can't have expired or be out of date. A family member with the same surname and address can also sign for it with their valid photo I.D. 

    Which did not happen noone signed for it or showed ID and I took it in for my mom who has different last name to me, so they broke there own rules in the first place so how can they be trusted >

    So you have to be a bit careful here. Did your mum give Sky her permission for you to talk to them over something you ordered on her account?

    For the benefit of anyone else in the same unlikely  position. The safest thing to do is to accept both phones, contact the sender preferably in writing (email is good as it's time stamped) and tell them you've received the phone they  cancelled and they are free to collect it. If they don't collect it then send them a reminder and keep the phone safe until they realise it's missing.

    Yes sorry I used the words I cause is was filling this out on my moms behalf so I apoglies for any confusion,

    I live with my mom we spilt bills = but the sky is in her name but we pay half each well infact i pay more due to skysports but never the less, I have always had a phone via her sky account and I just upgraded to this I phone 14 plus. I pay her monthy for it ect, So yes she fully aware. she also has a phone contract via sky and it was cheaper for me to have one as she already was with them if this makes sence, She orderd them just to be clear but they are mine.

    Yeah I agree, But like I said sky just told me to hand back the blue one which was cancelled. Which I did when I found out which 1 of the 2 was the blue one but they driver never gave me any proof of me returning it. I was just following what the sky agent told us to do.

    Royal Mail have not asked for signatures since the requirement was abandoned during covid.

    A photograph was substitued for a signature.

    The fact hey did not comply with Sky's deivery instructions is Sky's problem. You / your mum  not have that  contract with RM.

    Also, you have admitted you did receive it.

    Unfortunately, you do not have any proof of refusing delivery and the postman takinh the item away again.  

    . Refusing delivery is not the same as returning an item.  You have used both terms. 

    I expect the parcel is somewhere in the RM system that undelivered items are  passed to , as the parcel would not be addressed to Sky.

    Hopefully, there is something inside the parcel to identify it should go to Sky's depot ,  and will turn up at some point.
