Court changes or conflicting advice ccj

Options
I noticed the thread about the n180, mediation compulsory.......and it alerted me to the advice I'd had on here re ccj.......on checking I found this website:

Advice on this forum I have read said that if the ccj is paid within a month it DOESN'T go on your credit rating file.........this national debt deadline website information states it DOES stay on your file and IS likely to affect your ability to borrow.

So please can you tell me which is true?

  • I think the answer is in the difference between "within a Month" and "after one calendar Month"

I think you probably need to reread it in more detail.

Pedant alert - it's could have, not could of.

That link is talking about "if you have a CCJ".

You are thinking of the different scenario "if you lose at a hearing".  That's not a CCJ situation.  In that case, post hearing, if you pay within 30 days of judgment you'd never get a CCJ so would not fall into the "if you have a CCJ" category.

Ah right coupon-mad, yes, so I was thinking lost hearing = ccj ........ for isn't that what it is? A judge making decision in the CC? Sorry, but it appears court /terms sometimes don't make logic sense..... If you could make sense of that for me then it would certainly help me and maybe others......even reading through newbie threads sometimes it doesn't all go in. Certainly not at once !!

    Thanks

Losing in court or winning in court is the CCJ (County Court Judgment). What you are thinking about is the record of that loss being on your credit report.

A lost CCJ will not be on your credit report if the judgment amount is paid within a calendar month of the judgment. It will be as though it never happened.

Paying the judgment later than one calendar month after the judgment means that the lost CCJ remains on your credit record for 6 years but is marked as "satisfied". However, that is little more than a degree less painful than having a judgment that is still outstanding.

So, going to court and losing does not mean that you have a CCJ on your credit record as long as you pay it within one calendar month of judgment.

Not really.  Yes and no. If you lose at a hearing then judgment has been made but you have not "got a CCJ" (unless you don't pay).

Please don't worry. We don't risk anyone's credit rating with our advice. If you follow what we say it's impossible for you to "get a CCJ".
