Hello,

i had received a parking charge notice for parking on private road for about 8 minutes from the picture evidence sent of the letter. 

I have already read and copied th newbie post and sent appeal as suggested in the thread and its rejected.  Now asked to appeal to IAS - i know i can ignore this but is it worth appealing maybe they cancel? 🙈

So my question is that i just realised going back to the 2 letter that came in the post - the very first letter just said Parking Charge Notice (nowhere did it mention Notice to Keeper), the second letter came about 2-3 weeks after which said FINAL CHANCE BEFORE ACTION. 

Now does that mean they cant force the keeper to pay?

also, the private road does actually have any sign as you turn in the road to say its private. It has signs attached to the buildings on keft and right sides if the road. So when you turn straight into the road you cant see the signs and if you are alredy on the road you are not expected to look left or right for signs??

plus, the time frame of under 10 minutes - does this make case strong? 

Also, the driver was within the car the whole
time. One passenger just got off. 

Lastly, i checked on google map and my understanding is that the road is in the high street and only a small portion if it is private mainly the portion where the side road js linked to the shops on the main high street and further down are houses. 

Could somekne give me few pointers if i do chicken out and decide to pay because this is giving me anxiety 😟

    They have 6 years to issue a court claim using MCOL, if it gets to a hearing in your local civil court then if you lost in court they can enforce it against you if you fail to pay in full within 6 years following the incident date 

    Signage, landowner authority and consideration periods etc are all defence points 

    Doesn't matter if the driver was in the vehicle or gone away from the vehicle 

    Being on a call doesn't apply either 

    The driver needs to stay on public council roads in future, not unadopted or private roads or car parks

    You aren't going to chicken out and pay.  Even my own daughter is currently cheerfully ignoring UKCPM.  The advice is to ignore UKCPM because they WILL NOT cancel it.

    Tell them if you move house within 6 years.

    That's all.

    Come back if they try a court claim, which is not scary. It's independent 'dispute resolution' by another name.  Think of it as the appeal that's not currently available due to the IAS being unfit for purpose.

    Thank you for replies. I will ignore them for now. And wait to see if they do take me to court or not? Although if they never sent out a letter Notice to Keeper does the keeper have liability to pay? Because first letter that came was only with the charge notice.

    You are dealing with greedy scammers that use any dirty trick in the book just to extract money, I suspect they will say from your description that the road is private so no parking is allowed no grace period applies.
    They will also say that signage is adequate even though it isn't, you would be trespassing in such a case and they cannot invoke a contract anyway, but this is all supposition as we don't know the location, or what the signage says.

    The first postal notice sent to the keeper is the Notice to Keeper, which probably says Parking Charge Notice, or PCN for short 

    It is currently an unregulated industry with few laws or rules 

    You said that you appealed already so leave it at that, follow the advice above, because the parking company issued a PCN and won't cancel that PCN 

    Until the whole system is fit for purpose then it is what it is 

    Enforcement is currently after a court case, that is where liability is established

    The first letter you received was the NtK. Any subsequent letters are immaterial. It is the original NtK that counts as your "notice".
