My partner want to kick me out of our council accommodation

I have been living with my partner in a council house for over 10 years, during which time I have consistently paid the rent and bills. Recently, my partner and I have separated. As her name is the only one on the tenancy agreement, I am now facing the need to find alternative accommodation. This situation is further complicated by my ongoing treatment for a heart condition, and my financial difficulties which necessitates a stable living environment.

    Difficult situation for you but I suspect that hers is the only name of the tenancy you will need to move. 

    Are you able to find suitable private accommodation?  If not I suggest you contact Shelter as they will be able to help you through the relocation process.  If you simply contact the council they are likely to just put you into a hostel or similar.

    Speak to the council and see if they have anything suitable for you. Register with any local HAs too

    You say you have separated.  Where, currently, are you each living?? Both in the council property or otherwise, please?? (Depending on your answer the type of tenancy/lodger agreement (doesn't have to be written to be legal) may change: VERY significantly.)

    Was there ever any agreement over the terms of your occupancy (written or otherwise)??

    Any children involved? (joint kids or otherwise)??

    When you say you have been paying the rent do you mean ALL the rent & paying directly to the council (eg you can show with from bank statements)??

    We still live in the same council accommodation,  she ask me to leave ASAP.
    We claiming housing benefit under my self employed status.
    I only have 18 years old girl living with us.
    The rent paid from her bank account directly to the council , the council knows that I am the persone who incharge with the bills.

    Suggest you go see Citizens or any Shelter local housing advice centre and ask for advice

    I am not a lawyer but think you are formally a lodger and can just be given "reasonable" notice to leave - assuming England see,.....

    Hopefully something can be worked out.

    What they look at is the person whose name is on the tenancy.

    Go to the council for what assistance is available. 

    Might have to rent privately and claim assistance if entitled.
