Hi,
I successfully canceled 2 penalties in the past few years ago, but as I'm not doing that every week, I just would like reassurance that I'm doing the right thing so all the help as usual is much appreciated.
I received a lovely letter a few days ago from Civil Enforcement, this car park is in St Albans, next to the restaurant where I was a guest, and can confirm that with a screenshot from my bank statement.
From what I understand this is POFA version so that won't be that easy.
I think the landowner is the restaurant so I have typed a nice email to them but can someone confirm do I write in there 'I parked' or 'driver parked' as I'm not 100% sure. I guess it is a good idea to attach a screenshot from my bank statement? I will click 'send' as soon as I will get clarification.
Also, as I haven't seen too many examples of that kind of message to landowner do you think it is a good idea to paste it here for others to see and adjust if needed?
I understand, at the same time I need to appeal with a template from Newbies thread:
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close-up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.
If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.
Do I need to mention 'close-up actual photograph as they are on that pcn? There is no need to add a screenshot from bank statement as I understand?
Unfortunately, as I don't live locally I don't have any pictures of the signage but if needed I can go back there in the next week. Just not too sure if to appeal straight away or get pictures?
Is there anything I need to know or doing wrong?

Correct to use the standard blue text appeal wording without addition or modification. If/when complaining to the landowner, just use "the car was parked" or "we parked"2

The NtK does not comply with the requirements of PoFA 9(2)(e)(i). Therefore they cannot transfer liability from the unknown driver to the known keeper.
So, as advised, no "I parked...". Only "The driver parked...". Do not identify the unknown driver, inadvertently or otherwise.1 -

Yes you so, as seen in the examples.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
