Why not just continue to follow that checklist you were using when you filed a Defence?
Points 8, 9 and 10 on that list answer your questions.2 -
Definitely NO to a hearing on the papers. Reason:Mediation is now mandatory (if the claim was issued after 22nd May 2024). It is a 5 minute phone call where you offer £0.
I am not content for the case to be heard 'on the papers' because that seems to disproportionately give an advantage to a legally represented party. I feel strongly after all the intimidating demands from this aggressive parking firm and its agents, that I need a voice at an attended hearing.

Just in case anyone was following this post - I received a court date of January 28th back in November. However today I have received notice from DCB Legal that they are discontinuing court proceedings! Thanks to everyone on this post for their support and I'm pleased to now put an end to the matter4

Just jingled over to the disco thread. 👍Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
