    I don't know if it makes any difference but that contract does not give Parking Eye authority to progress to court.

    Wow! Please would you share the detail
    of that. My copy of the contract is heavily redacted with entire paragraphs blacked out.

    Have there not been several similar cases at Fistral Beach?

    Thanks, D-P, I see similarities in that they involve waiting, not parking, having problems paying or insufficient time being allowed to enter and exit. In our case POPLA decided that dropping off a passenger and waiting to park but being unable to do both constitute parking.

    We will argue those points but I think the Hospital Trust breaching NHS Parking Principles and the parking contract potentially not allowing PE to do court will be of greater impact.

    Hi, fisherjim, that info would make a huge impact. I looked carefully through my copy but there is no information regarding court claims. However there are lots of pages of mostly redacted stuff.

    If you have a clear copy available for me please, I would be very grateful as it should stop PE’s court threat dead in its tracks.

    It won't stop anything.  There is no silver bullet and none of this is new. It's useful but not different - it's just the usual stuff people always use in defences.

    C-M I don’t follow your reasoning, if there is incontrovertible evidence that PE do not not have authority to pursue court proceedings in their own name for the pcn then how is anything else relevant?  It is in my interest to get proceedings stopped prior to having to spend half a day in court. Am I missing something here?

    PEye always have that authority and it is likely in the redacted section of the agreement.

    I get that you want it stopped but who do you think is going to stop it?

    That is why I asked if fisherjim has an unredacted copy. Maybe fisherjim was simply guessing?

    I do understand that either I persuade the hospital to cancel or I will try to beat PE at the court game with the expert help of the forum. But if fisherjim was just speculating it is not helpful as it spreads confusion and I am easy to confuse!
