Faded Box junction.

Hi,

just have a question regarding the image below i appealed on the grounds of the lines are faded and poorly maintained however it got rejected as you can see below isit worth taking it further? It’s a lot worse from the view of the drivers seat compared to their Birds Eye view they have.

As we major on private parking tickets here, Free Traffic Legal Advice (FTLA) forum will be your best bet for council penalty charges. Register there but please note that a Hotmail address may not work - try using a throwaway Gmail account instead if you do have trouble registering, and post a new thread; here's your link:

Read the sticky 'Read this first before posting your case' as well as reading through some of the other threads there ahead of posting your own details, to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate), as they need to see all the small print.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

You are best to post council queries over on the ftla parking forum in the council section there after reading their posting requirements , same as this Birmingham one

I'd look up what the highway code says - It'll be 'no stopping on a box junction unless turning right and blocked ...' etc

Then look up the definition of a box junction. It says 'Where stationary traffic would be likely to block a junction, a yellow box may be marked on the road, covering all or part of the junction.'

But there isn't a box marked in that phote. A box is made up of a continuous line. I can't see one.
    The Gov.uk site shows this

You haven't entered that, because the council haven't maintained that pattern on the road. I think I'd argue that looked like a former box junction marking that was no longer in use as it's so faded - and the high camera angle probably gives a better view than a driver would have. Take a dash cam screen shot or get a passenger to take a pic when you drive there. I bet you can hardly see it from an acute angle. Good luck.
