    thank you everyone for your input. At the end of the contract with AE1 they did not give or send a list of viewers to show AE2 … even without this list AE2 would have a duty of care to ask any potential viewers had they previously viewed the property with another estate agent…

    Hello, could anyone please explain the 28 day rule at the end of a contract. Our contract ran for 12 weeks, on the last day we informed the estate agent that we would not be renewing it, we where told a letter of confirmation would be sent out … this was not sent… does the 6 month rule start on the date of cancellation or after 28 days of cancellation? Thank you…

    Depends on the terms of YOUR contract (or terms and conditions provided).  Sadly I can't read them from here, could you advise what is stated please?

    Hi
    I just cancelled with my estate agents they sent me an e mail with a list of people that have viewed my house . The e mail stated if I was to sell house to people that had viewed I would have to pay their fees

    However the (new) estate agent I instructed said that would only apply if they made an offer ? No idea who is correct.?

    I'm not quite sure what a 6 month rule is ?

It applies if you exchange contracts with someone introduced by the first EA. Presumably in order to get to Exchange they would first have to make and offer (even if the offer was the asking price))  No idea who is correct.? No me, as I don't understand what the new EA means.

    Hi artfulllodger, ‘ we will still be entitled to the fee if a memorandum of sale is issued by the other agent within 6 months of the date of termination of our instructions ( at the end of 28 days notice ) and where exchange of contracts takes place ‘ … not sure where the 28 days fits in .. thank you

    The 28 days is the length of notice you need to serve in order to end the contract.

    Taking a step back...


    In simple terms, your contract probably says...
    • Once the estate agent's contract starts, it goes on forever - until the house is sold, or you terminate the contract.
    • You can terminate the contract by giving (at least) 28 days notice
    • The minimum contract period is 12 weeks - so the contract cannot last less than 12 weeks. (But it could last 20 weeks, or 50 weeks or 100 weeks, etc)
    • If the estate agent is a member of the Property Ombudsman Scheme, the code of practice says you must be allowed to give written notice in week 8 if you want to, so the the contract terminates at the end of 12 weeks
    • If the estate agent isn't a member of that scheme - you need to read their contract. It might say that you cannot give 28 days written notice until week 12.

    The contract terminates at the end of that 28 day notice period. The 6 month period starts when the contract terminates. 

    (i.e. The 6 month period doesn't start on the date you give (at least) 28 days notice.)
