    Thank you. Yes there cleary is more to this than a disagreement, which is why I posted. I wondered if anyone had any experience of this sort of false accusation or of Keoghs. 
    your insistence on this being a false accusation or scam.
    For it to have got to Keoghs and Keoghs to have issued, there would have to be a fair amount of evidence available

    The third party has seemingly gone to a lot of hassle if this is a vindictive claim against you.

    As before all you can do is pass as much information on to aviva for them to defend the claim

    The claim is being made not by the driver but by someone else, presumably his partner at the same address. I wold call it fraud.The questions I asked are should I instruct a solicitor, file my defence, let Aviva deal with it? Any ideas please? 
    Assuming the claim is for less than £10000 it will be dealt with on the small claims track where legal costs are not recoverable - so any money you spend on a solicitor will be money that you never see again, regardless of the final outcome. 

    That's before we even get into the question of whether Aviva would allow you to run your own defence. If you did try to file a defence yourself without their agreement and you made a mess of it they would be within their rights not to cover you, leaving you liable for the eventual bill. 

    Let Aviva deal with it. You pay them l good money precisely so that when this sort of thing happens it's their problem, not yours. Give them as much information as you can about the circumstances (hopefully more than you've said here) and see what they decide. Be aware that they have the right to settle the claim or defend it as they see fit - it's their money, not your which is at stake - which might not be the way you would wish then to handle it. But you won't be paying either way.

    Aviva ultimately dont have a choice either about the OP running their own defence nor settling the third party claim if a court order is obtained against the OP. 

    Hence in the previous response pointed out that Aviva will want a letter of indemnity from the OP if they are to run their own defence, its not legally necessary, there will be the required terms in the policy to enable them to recover their outlay from the OP but it tends to make people think twice before deciding they are a better lawyer than the ones employed by their insurer.

  • I have recently changed my car from a group 23 to a group 3 and was told its ok no extra charge...does that mean i can go 20 groups higher than my original 23 to a 43 also with no extra charge ?

    You'd be better off starting your own thread, rather than resurrecting one that's 6 months old and has nothing to do with your question.
    But in answer to your question, "No".  Insurance groups are only a teeny-tiny factor in insurance pricing, the whole thing is based on a raft of statistical data.  One old chestnut being that something like a 1-litre Corsa can be surprisingly expensive to insure as it's often a favourite for newly-qualified drivers who statistically have more than their fair share of accidents.  But the data that are factored in are extremely varied, and the actual insurance group is just a tiny element - other stats will have a much bigger impact.

    Most insurers dont use the Thatchams car groups. The groups are mainly about cost of repairs with a lesser consideration to security and safety features. What they dont consider and insurers fine more important is what sort of person typically owns a hot hatch or a limo and what's their claims experience like?

    At one point we were looking either at a group 23 hot hatch at circa £25k as a fun car or a group 50 "executive" car at circa £95k as a once in a lifetime ownership. The group 23 car was about 50% more expensive to insure than the exec
