it would be good is someone can lay down the rules in having to get benefit top ups, no matter if it's a £ , cos the advisor said creditors would want maximise full sources of money.
hence the advisor refused to proceed cos I said I won't claim and if I did claim they said as they expect me to land a higher paying job within 12 months, that would put me over the £75 limit, they wouldn't proceed or give the link to fill in the forms.
I have run out of ideas what's next. I start my part time job this afternoon, the boss thinks he has some more hours , but that would stop a future dro application cos I be over the £75 limit.
plus never heard that rule in bankruptcy, you have to claim benefits if you are due them, no matter how tiny.
I thought bankruptcy can't be refused if you don't claim anything, cos you don't want to, surely you can't be forced, or the IP will reject bankruptcy application
bankruptcy, could it work staying in my low income, or will I be forced to claim a top up no matter how small, we have £1400 saved, but need old banger car for wife for work, it's a 1.5 mile walk at 6 am, no buses, she would have to do bankruptcy too.
but we both did a couple of small preferencial payments to creditors, can bankruptcy be rejected cos of that.

we wrote about dozen letters recorded delivery to our creditors yesterday showing our wages, other creditors debts,outgoings and asking them do make a decision, we have about £15 to be split amongst 11 creditors monthly
we have no debts to any priority company, eg rent, gas, we are up to date there we told them that.
did not declare our savings to them, but told them my only asset is a very old car
we also said we would not be claiming any benefits, no matter how tiny they are
we also asked them to write the debts off, unlikely tho.
fat belly, we have read lots of posts from other folks problems on this forum MSE and the solution is a dmp or bankruptcy, dro usually, my wife and I no longer have any solutionChristians Against Poverty solved my debt problem, when all other debt charities failed. A DRO would be a solution except that you have now met two intermediaries blocking your way
It's why I asked if you had a CMA centre near you. They don't process many DROs but they can, and I have heard many good things about them.
I suppose another would be CAP0 -
there is one about 45 miles away, it does email and phone, I'm rural England you see. there is a CAP in my town tho, you phone them first for advice
my main questions now are in bankruptcy, are you expected to claim UC no matter how small an amount, cos that is the main problem of the DRO rejection
if I don't need to claim , I will choose bankruptcy if needed and stay in my part time job,my new boss said he may have some more hours, but of course that would block a dro and give me an ipa in bankruptcy

in summary they would not recommend a dro , cos we would be claiming UC ( forced to)and we would expect to move to full-time employment in next 12 months from part time , thus stopping the dro within the 12 months and thus the debt it had frozen.
I also got the impression reading between the lines was to increase our earnings by 5 hours which takes us out the criteria to be eligible for any benefits,but then we would have to " lose" 5 hrs of wages in new expenses per week to stay under the £75 rule per month each
the only things missing from my budget was pet insurance and contents insurance.
the advisor refused to give us an allocation for an emergency fund for eg white goods
i could sense the advisor was hinting that many folk apply for dro, but once they hear they are too rich for a dro , they then start to increase their budget expenses fraudulently in order to fit into it.
I also got the impression that they thought knew best in their opinion , cos at one point they run through a potential IVA instead if we qualify or not, and I said woah, hold it right there,I own no house, and they also said regardless what I had read online about things about debts ,don't trust advice online unless it it is from an approved debt organisation such as them.Christians Against Poverty solved my debt problem, when all other debt charities failed. made an appointment with CAP Christians against poverty for next Wednesday, it's a home visit with an advisor for 1 and a half hours to work out a solution.
I will ask the question do we have to apply for UC no matter how small to be allowed to apply for bankruptcy or a DRO. and see what the advisor says.
cos money wellness said there are no solutions left except for £1 token payments for a long time it seems

From my limited knowledge on the matter, bankruptcy is pretty much self declared, you pays your money, and clicks the button, and that my friend, is that.
