"Request for information" email by Gladstones

Hi All, 

I have a claim in progress, received a claim form from Gladstones acting on behalf of Parking Control Management. 
I have filed the Acknowledgement of Service as advised on this forum.
I have then filed my Defence.

To give a bit more info, I was loading the car and collecting the items I had ordered  (heavy paint) from a store, so for under 10 minutes my car was placed into a residential bay marked with a "V" (visitor). Poor/misleading signage is in place, and their camera used to take their evidence shows that the photos are all timestamped within under 60 seconds of each other, so in my view the car has not been observed long enough to assess whether loading/unloading was taking place.

7 Days ago I received the following email (copied below in bold) from Gladstones regarding a clarification on my address, and my questions are:

- am I legally required to reply to them or should I just ignore them?
- should I just reply confirming my address?
- should I reply, confirm my address, and perhaps take the opportunity to write something else to dissuade them from pursuing the case further?

Dear Mr XXXXXXXX

Request for Information   We email further to the Acknowledgment of Service, you have filed in relation to Claim Number XXXXXXX, and note a different address is indicated to the address we hold on our system.We should be grateful for you to confirm if the address within the Acknowledgment of Service is your current residential address, or a correspondence address in relation to this claim only (XXXXXXXXXXXX).Please note our systems cannot be updated (if applicable), until we are in receipt of the requested information.  Please also note therefore, we cannot update any Data Controller/Data Processor whom we have shared your data with, including our client, until such times as we have received the same. We have however, in the meantime noted the address within the Acknowledgment of Service, as a correspondence address on our system, for this claim only XXXXXXX.We look forward to hearing from you.

    You should definitely confirm the correct address for the service of papers, Which may be your own current address 

    Ditto with the DPO at PCM UK ltd too

    Was the claim filed to the same address as that you indicated in your AoS? If so, why?

    Do you want to run the risk of some important paperwork being sent to a wrong address, especially if that could mean risking a judgment in default?

    There is nothing wrong in telling the solicitors which address they should be using. Make sure you tell them to erase the wrong address.

    Thanks for the replies, I'll follow the advice and confirm the correct address with Gladstones.

    The claim was filed to a different address as my car is registered to that particular address, I am in the process of updating it but it does take a few weeks.

    AFTER FIRST FILING YOUR DEFENCE:

    THEN RESPOND:

    Show the evidence that the new address is your place of residence (utility bill) and also copy in the CNBC (the AOS email if there is one) and insist BOTH the court service and Gladstones and their client now erase the old address as it is not suitable for service of court documents.

    Do this even though it was on your AOS.

    Don't expect many common sense or proactive stuff from the overworked CNBC.  Put it in words of one syllable that the old address MUST NOT be used and must be erased immediately.

    But defend FIRST (just in case the CNBC think your email about your address is your defence).
