Landlord or Tennant cost?

Hi all, i let out an apartment in a block of 5 apartments. They have decided to paint and re-carpet all communal areas at a cost of £420 per apartment. Is this something that i should be paying for, the tenant or meet halfway? Thanks.

    Sounds like something that would normally be in the service charge for the block?  Who pays the service charge - you or the tenant?

    What does your lease state and your tenancy agreement?

    Normally the freeholder would pass this to the leaseholder via the service charge and it would stay with the leaseholder and not be passed directly to the tenant. The improved communal environments will financially benefit you on the both the sale of the leasehold or when negotiating the rent with this or the next tenant given the improved environment.

    and of course the upgraded facilities will probably outlive the term of the tenancy.

    Leave David out of it.



    This work is something the freeholder is going to charge you, the leaseholder for, and you can't pass that cost on to the tenant unless, possibly, the tenant did something that meant the communal areas had to be painted and carpets replaced.

    Even then surely freeholder would need to get agreement or take court action against tenant: And you would already (tried to) have evicted tenant....

    Ok so there's a Freeholder, Leaseholder=Flat landlord, and Flat Tenant.
    * Which one are you - leaseholder? share of freehold? 
    * Which one is they? 
    * Was the repainting due to specific damage, or normal wear & tear? 

    If they = freeholder, and the painting was just worn, then this is covered by their agreement with the leaseholder to reimburse a share of of the cost via either service charges or an ad hoc billing. The tenant has nothing to do with normal wear & tear, so they pay nothing. 

    If those assumptions don't hold, then please clarify.
