PCN on a “FREE” car park.


This really has got me annoyed.
Someone parked on a retailer car park, their site as only them on it.
Parking is Free for 90 mins then all you have to do is input your reg no for another 90 mins of parking. No charges just input the reg no.
Parked there many times before for 90mins plus with no issues but these rules are new, as confimed by the site approx. a month ago.
Now the Gov documentation (Guidance on Section 56 and Schedule 4 of the Protection of Freedoms Act 2012:Recovery of Unpaid Parking Charges) states
“Charges for breaking a parking contract must be reasonable and a genuine pre-estimate of loss. This means charges must compensate the landholder only for the loss they are likely to suffer because the parking contract has been broken.”
How can not inputting a reg no equate to any loss. There is no charge for using the car park and no time limit of a stay.
So the £100 PCN just seems like a money making opportunity for the parking co.
The only “Rule” seems to be if staying over 90mins you have to input a reg number, NO payment is ever due so how can there be a loss.
Any ideas?

Which parking firm?
Have you complained to the retailer, asking them to intervene and get the PCN cancelled?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Yep. Forget the out of date stuff about loss. You are looking at the wrong thing entirely.
Binned by the wrinkly out-of-touch rich Judges in the Supreme Court nine years ago.
