Nexus Appeal turned down - please advise.

I really can't afford £100 but not sure what my next step should be. I have read the other threads so apologies if this feels like a rehash but I couldn't see where else to post. Happy to delete and repost elsewhere if a more suitable place.

My initial appeal:

Re PCN number:  I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner. There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle. If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it. If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

Nexus response - received today

Dear Sir/Madam,


Thank you for your correspondence relating to your Parking Charge.


The Charge was issued and the signage is displayed in compliance with The British Parking Association’s Approved Operator Scheme Code of Practice and all relevant laws and regulations. 


Clear signs at the entrance of this site and throughout inform drivers of the 3-hour limit, and it is not possible to access any part of the premises without passing multiple signs. Your representations are not considered a mitigating circumstance for appeal.


We confirm the Charge was issued under Schedule 4 of the Protection of Freedoms Act 2012. As such, we are holding the registered keeper of the vehicle liable.


In light of this, on this occasion, your representations have been carefully considered and rejected.


We can confirm that we will hold the Charge at the current rate of £100 for a further 14 days from the date of this correspondence. If no payment is received within this period, and no further appeal to POPLA is made, the Charge will escalate and further costs may be added.

    No advice here tells you to pay.

    What about Plan A?

    Its not a fine, its a Parking Charge Notice, PCN

    I think that as the keeper you should draft a Popla appeal and submit it 

    Nobody should be paying Group Nexus 

    Plan A is the best option here, especially if GN complied with POFA 2012

    I wouldn't do POPLA.  Not for a retail park overstay case
