Banbury EASTMSCP ( ANPR ) Car Parking



I have received a Parking Charge Notice for alleged contravention of Breach of the Terms of use of the car park above. I used the scan-pay service and paid the £5.50 at the station.
There are 2 images of my car, one entering and one is still parked. There are 2 site codes associated with the contravention I'm not sure what has happened really.
If go down the route of appealing what does the process involve?
Do they ask for proof of purchase.?
I know its easier to ignore these letters. I have been unable to access the newbies appeal statement. It's not worth the arguments at home and I know it wont end here.

Plan A is always a complain from the keeper to the landowner.
Plan B is for the keeper to appeal without identifying the driver.
Which parking company issued the charge?
Ignoring is a bad idea and hasn't been recommended since the law changed in 2012.

I believe that this is Banbury East Multi Storey Car Park. I think it's APCOA.
Just send the following as you appeal (verbatim) without indicating who was driving. You are appealing as the keeper. Do not, under any circumstances, reveal the identity of the driver, inadvertently or otherwise.I am the registered keeper. APCOA (or whoever issued the PCN) cannot hold a registered keeper liable for any alleged contravention on land that is under statutory control. As a matter of fact and law, APCOA will be well aware that they cannot use the PoFA provisions because Banbury Station is not 'relevant land'.
If the train operator wanted to hold owners or keepers liable under Railway Byelaws, that would be within the landowner's gift and another matter entirely. However, not only is that not pleaded, it is also not legally possible because APCOA is not the station landowner and your 'parking charge' is not and never attempts to be a penalty. It is created for APCOA's own profit (as opposed to a byelaws penalty that goes to the public purse) and APCOA has relied on contract law allegations of breach against the driver only.
The registered keeper cannot be presumed or inferred to have been the driver, nor pursued under some twisted interpretation of the law of agency. Your NTK can only hold the driver liable. APCOA have no hope at POPLA, so you are urged to save us both a complete waste of time and cancel the PCN.
