    Should I email all three/four via BCC, or send one to the court and another to the claimant?

    I don't think the DPO needs a copy.  The other one struck through is not on my list of working e-mails for CE.

    I received an email from the court on 14/08/2024 regarding a pre-booked mediation phone call scheduled for 28/08/24 However, in my Directions Questionnaire, I indicated that I do not wish to participate in mediation and to proceed to court in front of a judge.

    In part of the e-mail its states the following

    You must make sure you have provided us with, or confirmed, the name and number of the person who will be conducting the mediation appointment. If you have not done this, or need to update your telephone number, you should contact us using the details at the end of this letter no less than 5 working days before your mediation appointment. Failure to do so may result in your mediation appointment not taking place and may result in a Judge issuing a penalty where the mediation was mandatory.

    Is mediation mandatory? If it is not, what steps should I take? If it is mandatory, I would like to state to the mediator that I am only willing to agree to a settlement if the "PCN" is cancelled. Otherwise, I am prepared to go to court if the claimant chooses to continue pursuing their case.

    Thanks all for all the help so far everyone. Learning as I go but its been an eye opener on how the court system operates.

    Plenty of recent posts about mandatory mediation and the changeover date back in May 

    In theory you can cancel mediation if the claim is before that date, otherwise its mandatory, or proceed with it anyway using your proposed £ zero offer, a 5 minute phone call, no compromise, end the call 

    Its not the PCN you want cancelling, its the court claim, a Discontinuance, same as nearly all the other cases

    This is covered already in the first 12 steps of the Template Defence. It changed in the last week in May but with a Claim Issue Date of 17th May you can safely say no.

    Cancel it.
