Gym membership mis sold

Hello, I bought a premium David Lloyd membership advised I can use my guest passes in all clubs. Most clubs are being upgraded and the passes aren’t valid anywhere which is not what was sold to me. What are my options here? It’s super expensive.

    It is unusual that guest passes can be used in any club.  It is typical that own membership may allow multi club access, which often has a tiered approach so, if your home club is tier 2, you can access tier 2 & 3 but not tier 1.

    Guest passes are offered as an incentive in the hope your guest will join.

    What exactly do the Ts&C's say?

    Your options depend upon the terms amd conditions of the contract and whether they have breached them.  If they haven't breached them, your options are to continue your membership, or terminate it with whatever contractual notice you agreed to provide when you signed up.

    Cancel or alter your membership when they come up for renewal.

    Who advised you? What did they say exactly? Was this written down or just verbal? Was this a personal account or is this linked to a business contract? 

    As others have said, seems strange that you’d be able to use guest passes; but I know some business accounts have this set up to offer to visiting big wigs. 

    Unfortunately, if you can’t remember exactly what was said/have no written proof I think you’ll have a tricky time to show this is a breach of contract, especially if the terms are not in your favour.

    For what it is worth, when I was a DL member I was able to use guest passes in any club. Admittedly, that was a few years ago (we relocated in 2019 and I cancelled my membership as the nearest DL is now many miles away) but it was certainly the case all the time I was with them.

    DL doesn't have publicly listed "premium" subscription that the OP states they have but have Platinum which enables you to use any club at your clubs standard or below and Diamond which allows you to use all clubs other than a handful of central London ones. 

    Its not clear what timescale we are talking over as the OP seems to have bought the Platinum level with the intent of using other local clubs but since signing up those other clubs have received improvements and so have increased their category and so no longer open to the OP. 

    Things like what tier a club is is only going to be true at the point of the statement and never a guarantee that they won't add a pool or squeeze in a hot tub and therefore increase the category. The contract won't say you can also use club ABC but will state you can use all clubs categorised as the same or lower than your home club which again doesn't promise that categories won't change.

    That realignment of club gradings must be a common thing across gym chains as Nuffield Health have also recently adjusted their club groupings.  It is also a way for the chain to increase the membership fees of some clubs.  It caused some displeasure at my club because of the next local club being omitted.

    The OP's concern seems to be not about their own access to other clubs, but taking guests to other clubs.  It seems a slightly different concern.

    TBH - I feel the whole grading of clubs and allowing to use certain tiers but not others is a bit pointless.  Most people are only going to use another club a few times in a year, perhaps holiday or work trip.
