  • @Coupon-mad No, it was just me and the judge. I was confident that either the PoC or the signs would fail, but he went through my WS and failed it on both. My costs claim was significant, but I wasn't expecting anything at all in honesty. He said he couldn't grant more than £95 as per one of the CPRs.

  • @Coupon-mad I've had to use this forum a few times over the years now and it's great. I try my hardest not to get fined, but they firms make it very easy to do so. I really appreciate all the help.

    I wondered whether all this information could be better arranged into a website/tool? It might already exist elsewhere, but something like the tools for generating letters to car finance companies would be great for this too. Like a template generator of sorts maybe? Obviously not criticising the forum or the fine people like yourself that use it. It's invaluable.

    Good idea but as the industry is due to be regulated in 2025, a lot will change. This isn't the moment to set up a different website. The Template Defence will no longer be right. Appeals won't be the same.

    So we need to wait to see what the Labour Government issue as the statutory Code.

    It could be like the terrible spelling on phishing attempts.

    If they know they're unlikely to win against a competent defense they may as well formulate their POC in order to thrown out at the earliest possible stage, before they're spent money on a representation or put any more effort towards a case they'll end up losing. (In the same way: someone naïve enough to fall for an obviously fake phishing e-mail is likely to be naïve enough to actually send money; whereas a realistic e-mail would have the scammers' time wasted by people who don't spot it's fake but smell a rat when the money is asked for.)

    People who are going to intimidated into paying (who don't come here, or have the fight stand up to them) are probably more intimidated by the lack of specificity, inclined to presume that they should have their own records to form a defense.

    Either way, the poor POC may actually benefit them, until such a time as the courts routinely throw out cases with terrible POC before sending anything to the alleged debtor and start issuing meaningful sanctions against repeat offenders.
