    Who/what took the images, CCTV or operative with camera?

    Is there not some element here of minimising losses. ie if the attendant deliberately sat and took images rather than advising that the driver might be in breach of the TsCs?

    What is actually in the position where the image was taken from? Is there a visitor parking slot? Was the attendant likely to be parked in there do they have a visitor parking permit to park there?

    I would be considering if there is evidence to counter the failure to park in a marked slot?  Is the parking operative was parked in a visitor slot? Possibly without a permit. Entrapping legitimate visitors rather than mitigating any problems by engaging and advising the drivers that by stopping where the driver did they might be in breach.

    @BikingBud An operative took the pictures, no cameras of any kind on site. They just turn up at random times and check, rules apparently in place 24/7. There's other PCM controlled sites nearby so I think they just walk over, never seen them drive in.

    They took the pictures from outside the controlled parking area looking towards it, basically just standing on the public road ~20 metres from the car

    Visitors bays are available but they're not close enough to my property for easy unloading. It's very common for residents or delivery drivers to stop in that part of the car park and unload

    Just ignore it till you get a claim.

    Like I said, I agreed with everything you said in the post above where I replied to you and I don't understand why you then concluded that what you did can be deemed as 'parked'.

    @Coupon-mad I think I assumed you were saying you'd agreed to what gripr had said, apologies.

    I don't mean to clog the forum and look like I'm not taking the advice, I'm just trying to better understand the rules of my own car park.

    If it was my ticket, I'd happily defend at court but I can't expect the keeper to do that so I don't think they'll go past the normal appeals processes. I was hoping I could find clear breach of CoPs along with the unloading defence to make the appeal a sure thing and scare off the PPC.

    Surely they can ignore threatograms?  If the keeper is an elderly or vulnerable relative, change the address for service to YOURS and you can laugh at the letters for them and tell the keeper you are handling it.

  • Tried that, they said it had to be given using their form which they posted out. I was worried the wording would hinder the appeal by signing a document that said 'parked'. 

    Also didn't help that asking for the form puts 2 week pause on discounted charge, but they apparently used horse and cart as it took 7 of those days for a letter to be delivered 1 county over.

    Would taking appeal consent mean court claims would fall to me as well? As I thought they'd still go to keeper of vehicle

    I understand that its convoluted, but I don't know the keeper well enough to push them to defend and wait for a court date. I think, like a lot of people, the threat of court isn't worth the hassle over £60.

    I'd also rather not give PCM a penny, so if there's a way to transfer the claim to myself that doesn't involve lying and saying I was the driver then I'd happily do that.
