TFL ULEZ penalty notice

Hi

We have received a notice from TFL for the ULEZ unpaid charge for one day.

My husband and I visited London recently for an overnight stay and our vehicle is not ULEZ compliant.  We were 100 percent aware of this as we went through and that we needed to pay the ULEZ charge.  We were also aware that we could pay this within 3 days, so my husband set up an autopay account via the TFL website the following day, where he read that all charges for being in the zone would be automatically taken from his bank account at the end of the month.  Job done...or so he thought until the penalty notice arrived.  The notice is only for the 1st day of our stay.  He contacted them and was told that the second day of our stay was covered by the autopay account, but the first day was not because the autopay account was set up the following day.

This is the exact wording on their website: -
"Auto Pay records the number of charging days a vehicle travels in the Congestion Charge zone and, if your vehicle does not meet the emissions standards, the ULEZ and LEZ. It bills users each month".

On this basis, we fully believed that, as our vehicle passed through the zone within two consecutive days and in the same month, we would be covered by the autopay for our stay, regardless of which of the two dates we set it up, and especially as we set the account up within the allowed 3 days to pay the ULEZ charges.

My question is, does anyone think this is worth us appealing?

Thanks

  • Hi,

I have been embroiled in two extremely painstaking Ulez charge disputes made the same weekend on my way to and from Heathrow airport to be witness at my oldest friend's wedding in France . It has been ongoing and painful for over 2 months now and I have done absolutely everything by the book and in my power to have these revoked. Finally last week one of them was cancelled but they are now trying to charge me triple the amount for the first one on the grounds that it was never paid (I have proof that I paid for it but apparently it was to a fraudulent hoax company, how was I to know or be aware, take "responsibility" as one TFL manage told me to double check this, I live far from London, didn't even know the Ulez charge existed and have never driven to Heathrow on my own before???...)

Although I have been fighting this non stop, answering every email, making 5 different calls, waiting for managers form the TFL to contact me and always made representations online well before the deadline, they are saying I have not done so before the 28 days and that I need to pay £270! They are also asking for proof but somehow with all my letters and emails, I cannot find actual proof of this also because when I first tried to make a representation their site crashed so I lost hours of work which I had to send again a few days later. I made yet another representation today and it crashed again, luckily I had saved it this time and managed to send it but I have spent hours and hours over this already and the stress is starting to really affect me, they have been less than helpful or compliant and understanding about any of this. Help please!
