Refused refund for returned goods

I recently ordered a new sink from Amazon via. 3 party reseller.  While I measured the sink outer dimensions I didn’t take account of the inner ones so asked for a refund.

the reseller sent the RMA details and I returned it in the original packaging. As they don’t offer a collection service

the seller claims the goods were damaged in transit and credited me £6 of £119 purchase price.

They cannot though provide a POD from the courier saying the item was signed for by them damaged.

Without this can they blame the courier as damaged could have occurred in their own returns while being processed possibly ?

did you arrange your own courier and pay for the return or did you get to return label which enabled you to return it free of charge using their courier

    Welcome to the forum.

    Who was the courier?
I assume that you chose them and paid them to return the sink to the seller. If so then the seller has no contractual relationship with the courier so the courier is entitled to ignore any requests from them.

You however can ask the courier for evidence that they delivered it satisfactorily. It's your contract.

What value did you place on the sink when you sent it? Couriers like to offer what they call 'insurance' for goods they transport, for exactly this type of situation.

In the first instance I'd be asking the seller for photos of the damage.

Courier insurance generally excludes articles made of ceramic (with a couple of notable exceptions that have specialist wine services they can utilise for),

Assuming you selected the courier yourself you might find this thread interesting.  (I know it's loss of a parcel and not damage but I don't see why you couldn't use the same argument against the courier for the loss in value of the sink).

I do agree it's worth considering but I think in more than less cases a damaged parcel comes down to a lack of packaging, the OP using the original packaging does IMHO put them in a better position to say it was sufficiently packaged (as it made it through the system once already and the seller or product manufacturer are the experts who would should know what packaging is required). :)

On a more straightforward note if OP was returning within 30 days I believe they can open an A-Z claim on Amazon and let Amazon arbitrate the matter.
