I'm not sure they would. My insurance company owed me a partial refund when I changed my car, and the money was back in my account within a few days. When my mum's car was written off, there was a bit of back and forth to agree the value, but once that was agreed she was paid out quickly.Rob5342 said:
If it was the other way round then the insurance company would almost certainly drag their heels in returning it.TheBanker said:
I wouldn't leave it a few months as suggested above. It is a criminal offence to dishonestly retain a wrongful credit.MAR5DEN_2 said:So I got paid via bank transfer the money cleared I never noticed as I rarely check my account I received it a few months back I lost the cheque as I've just recently moved I cashed it in to day I was looking back on my account today as I was trying to find a payment from someone and noticed it
We don't really know how the OP came to receive two payments. If he originally received a cheque, which he lost, then received a direct credit which he didn't see in his bank, there isn't really any evidence of 'dragging their heels' by the insurer, is there?
In my view the OP's actions could be interpreted as fraud and/or theft (I am not saying the OP has attempred to defraud or steal, simply that that's how it could be interpreted). So it is in the OP's interests to contact the insurance company to rectify the situation.1 -
The OP hasn't confirmed (or otherwise) that the cheque/payment are from an insurance company.
The warnings about a possible scam are worth repeating.

Indeed. If the payments are from somewhere else, then the OP should seek advice from their own bank before returning the overpayment.flaneurs_lobster said:The OP hasn't confirmed (or otherwise) that the cheque/payment are from an insurance company.

Hopefully, whoever issued this cheque will have cancelled it when they were told it was missing, so it will be returned unpaid. That would be the best outcome for the OP as they won't have to return any funds to anyone.0 -
Just to clarify, did you find the original cheque again after having temporarily mislaid it, or did you permanently lose it and have to arrange a replacement?MAR5DEN_2 said:So I got paid via bank transfer the money cleared I never noticed as I rarely check my account I received it a few months back I lost the cheque as I've just recently moved I cashed it in to day I was looking back on my account today as I was trying to find a payment from someone and noticed it0
