Seperation and Stamp Duty

(cross posted into home-buying, wasnt sure where it sat)

I am in the early process of seperating from my Husband. I want to buy him out of our family home.  I have had a mortgage appointment but due to the sums involved I am aware that Stamp Duty is liable unless you are a married couple who are seperating/divorcing.  My question is what legal stage / legal evidence do you need to have/ be at before you can apply for stamp duty exemption?

We are both keen to seperate finances and move on as quickly as possible (all split of assets and buy out prices agreed, just no paperwork started).
