Getting back excess after non-fault accident.

I was stationery, car hit me.  They gave false details, but I had a photo of their licence plate and told my insurers.

Initially, my insurers sorted my repairs and I paid a £700 excess and, upon renewal, my premium increased significantly.

After a few months, the third party admitted liability and my insurer changed my claim to a non-fault and reduced my premium accordingly.

I contacted the third party insurer saying I wanted them to refund my £700 excess or I'd take them to small claims.  Their reply was:

"I can confirm your insurers have requested payment for your excess already, we raised this payment back to them so once they receive it they should reimburse this to you."

It's been a further two months and I've heard nothing from my insurer.  Could someone with better knowledge on this please advise on what I should do?  Am I entitled to have my excess returned?

I had a similar thing in Feb 2023.   It was a non-fault for me but I had to pay £600 excess.   When it was finally settled as a Non-Fault I had to chase the third party insurer for my excess back.   When I did they advised that they had already paid it to my insurer two months earlier.     I contacted my insurer and they "forgot" to forward the £600 to me.    I then had to chase two or three times before they actually sent me the money.   Very frustrating experience all round and it took over a year from accident to resolution.    I'm no fan of Car Insurance companies.

Have you spoken to your insurer in the past two months and asked them why they haven't passed it on to you? (assuming they have received it).

Ok, very interesting!  Thank you - I'll chase my insurer.

No, that was my next step.  But I was a bit confused as to whether I'm owed it.

You entitled to it... when reclaimed our outlay out stock letter would say the claim was £2,500, the £500 was deducted so please reimburse us £2,000. Sometimes we got a cheque for £2,000, sometimes we got two cheques one for us for £2,000 and one for the policyholder for £500 and other times we got one cheque for £2,500.

Ideally your insurer would have spotted it automatically and forwarded it on to you but especially in the final scenario it's not always spotted and files auto-close.

A quick call to your claims department saying you've attempted to recover your excess from the TPI but they advised they've already sent it to your insurers and they should be able to check what's happened.
