My day 33 is tomorrow so I have to get a response in today :(

Ok, so you drive to the perimeter of the carpark. You pass an ANPR camera.

The clock is ticking (before your car is even parked). Say it takes 4 minutes to find a spot, park and grab your bag and 3 mins to drive round a one-way car park to the exit, that's 7 mins right there, when the car isn't actually parked at all. We're this a pay & display car park you'd pay for the period of parking excluding these elements (and would not receive a PCN).

If you spent time reading the terms to decide to park, you'd easily lose more time on entry. There's a complete failure to apply a grace period, isn't there?

Just received this response from POPLA, 2 days after raising my appeal. Thanks for the input guys :)

    Dear Mr X,
The operator has contacted us and told us that they have withdrawn your appeal.
If you have already paid your parking charge, this is the reason your appeal will have been withdrawn. Unfortunately, you cannot pay your parking charge and appeal, which means that POPLA’s involvement in your appeal has ended. You will not be able to request a refund of the amount paid in order to resubmit your appeal to us.
If you have not paid your parking charge, the operator has reviewed your appeal and chosen to cancel the parking charge. As the operator has withdrawn your appeal, POPLA’s involvement has now ended and you do not need to take any further action.
    Kind regards
    POPLA Team

Well done. While 'The operator has contacted us and told us that they have withdrawn your appeal' doesn't make literal sense (only you could withdraw your appeal), the end result is .... it's over. Good result. BaySentry sunk!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
