  • Hello, I recieved a letter from Link Financial stating they will pass my details to Resolve Call for a home visit.

    Am I right in thinking I can ignore them as I would like to pass enough time so my debt is hopefully statue barred in 2026. In the interim, i am keeping an eye on my post for a LBA.

    For reference, I am considering sending a prove it letter to Link but am undecided

    Yes Resolvecall are regulars to this board, they are nothing to worry about, and you should not engage with them at all, most likely you will just find a card or letter on your doormat.

    If you happen to be in, just say no thank you, and ask them to leave, for the purposes of the limitation act, a debt must be acknowledged in writing, verbal comms do not count.

    I would not do anything yet about this debt, you want to get over the line with it, did you ever establish the default date for this debt?

    If you are hoping the debt may become statute barred soon (when was the default date?), I would try to avoid any correspondence with Link, including sending a prove it letter. Simpler to not respond to Resolve call as @sourcrates suggest.

    Thank you for the quick response. I lost my origial default letter therfore I am going by the date on my credit report. (April)

    They only need send a compliant pre-action letter in order to render use of the limitation act null and void.

    They have till April to do that, radio silence is the best course of action until then, unless you get the pre-action letter, then you must agree a payment arrangement to avoid the matter progressing to court, in order to avoid a CCJ.

    Annoying as that may be so close to the line, fingers crossed it won`t get to that, but the next step if Resolvecall are unsuccessful might be legal action, just so you are prepared for that.

  • Hello again, I have a few questions where I hope you can help.

    Quick recap: i have a debt with Link that officially defaulted in April 2020 and is reflected on my credit report. However, upon reviewing my credit report, it appears Link has only recorded the default from December 2021 as per below screenshot.

    For the record, my plan is to allow the account to become statue barred whilst keeping an eye on the post for a LBA.

    Question 1- Does the recording of the default from December 2021 represent an error? Should the default have been recorded from April 2020, when the account originally defaulted?

    Question 2- If its a mistake, would it be advisable not to raise this with Link until the debt has become statute‑barred?

    Question 3: When is the debt become statue barred? Am i right thinking its the last payment and not date of default?. If its the last payment, then i will go through 2020 statements as the date may be approaching quicker than expected. (to confirm, i haven't made any attempt to contact them in writing etc)

    Its the date of default that is the cause of action date here, the 8th of April 2020.

    This was determined by an appeal court ruling some years ago.

    I would assume the entry for December 2021 would be the date that Link started reporting on your account, and previous entries were made by the original creditor on there own entry, so not an error no.

    You have two months to go till this is statute barred.

  • In my case, its not 6 years and the debt will be statue barred but 6.5 years. Thank you for clarifying before I contacted them!
