Loss of FTB status due to inheriting the proceeds of an estate (not a named property)?

    I would email the ea (they might still be picking up emails, or at least it'll be waiting for them when they get back to the office).

    Dear ea, thank you for your input re my FTB status and CGT issues. I shall however follow my solicitor's advice.

    That's not likely to help the OP in getting their offer accepted by the seller (who will be advised by their EA).

    As an update I’ve sent bank statements for some of my savings accounts, a copy of my husband’s Will, and a copy of the Grant of Probate via email to the estate agent. The funds in the accounts I’ve sent them statements for, show funds well in excess of what I need in addition to the sale of my late husband’s rental property. Hopefully that will be sufficient for them to drop the issue and leave it to my solicitor. 

    Just as a point, as a couple of people mentioned it, CGT won’t be due because the property is being sold for less than the value for Probate.

    I think the only reason CGT came up was because you mentioned it twice in your original post - suspect it was a typo and you actually meant SDLT...

    Frankly I think you are being very accommodating to what looks like a total numpty of an EA, but if it gets you over the line... I hope you will follow up with a formal complaint later, to stop them doing it to others in future.

    No advice but just to say all the best for the future to you and your children pjs493.  My husband died suddenly of cardiac arrest, and having to deal with all this 'sadmin' whilst grieving is hell on earth.  I remember being told I'd have to go in person the 20 miles to the 02 shop with my husband's death certificate to 'prove' his death, my husband had our contracts in his name and they would not talk to me.  When I got to the shop the kid said 'we don't need to see that'.

    Thank you for your condolences. Fortunately, the only place I had to physically take stuff to was the local Job Centre so DWP could release the Bereavement Support Payments without the need to send things through the post. The staff there acted with such compassion it actually made me cry more. 

    HMRC were also very good over the phone. One lady I spoke to helped me change my tax code as well as help me by sending the forms I needed to complete my late husband's tax return.

    SDLT geek on here literally knows stamp duty laws inside out. He confirms you are right. 

    So does your solicitor as they are ultimately responsible for accounting to HMRC

    The estate agent is a complete idiot - we can all agree on that ! Does he talk like "staff lets flats" ?
