Hi there,
In the past 18 months I have lost both of my parents, my Dad 6 weeks ago.
When my Mum died, I don’t believe that Dad removed her from the house deeds.
As executor of their property which will be sold once probate has been granted, do I have to make sure both names are removed?

You should leave the house in the names of your parents. There is no need to change the Land Registry entry until the house is sold. The solicitors will register the house in the name of the new owner.

Unless you plan to move into the house because you’ve inherited it, don’t change the names at all. Otherwise you could be liable for SDLT. Wait until it is sold and the names can be changed at that point when it is registered by the buyers once the sale is completed.My husband owned a rental property when he died and it was in his sole name. I’m now in the process of selling it. If I’d changed it into my name I would have lost my first time buyer status and would be looking at a £7k SDLT bill on the house I’m in the process of buying for myself and our children.0
